Terms and Conditions

Section 1 – Scope of Application

These Terms and Conditions shall apply exclusively to all business relationships between you and sizezero GmbH in the version valid at the time of your order.

Any deviations from these Terms and Conditions shall only be valid if agreed in writing and expressly confirmed by us.

Your contractual partner for all orders placed via this website is sizezero GmbH.

Section 3 – Formation of the Contract

By submitting an order, you make a legally binding offer to enter into a purchase agreement with sizezero GmbH.

The purchase contract is concluded only when we accept your offer by dispatching the ordered goods.

The automatically generated order confirmation sent after receipt of your order does not constitute acceptance of your offer. It merely confirms that your order has been received.

Likewise, the transmission of our bank account details for payment by bank transfer (prepayment) does not constitute acceptance of your offer.

The contract text will be stored by us.

The details of your order are contained in the order confirmation sent to you by email. You may view or download the current version of these Terms and Conditions at any time on this website.

Contracts may be concluded in either German or English.

Section 4 – Right of Withdrawal

Right of Withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period is 14 days from the day on which you, or a third party designated by you who is not the carrier, takes possession of the goods.

To exercise your right of withdrawal, you must inform us of your decision to withdraw from this contract by means of a clear statement (for example by letter or email).

You may use the model withdrawal form provided below, although this is not mandatory.

To meet the withdrawal deadline, it is sufficient that you send your notification concerning the exercise of the right of withdrawal before the withdrawal period has expired.

Effects of Withdrawal

If you withdraw from this contract, we will reimburse all payments received from you, including the costs of standard delivery (except for any additional costs resulting from your choice of a delivery method other than the least expensive standard delivery offered by us), without undue delay and no later than 14 days from the day on which we receive your notice of withdrawal.

Reimbursement will be made using the same payment method you used for the original transaction unless expressly agreed otherwise. You will not incur any fees as a result of the reimbursement.

We may withhold reimbursement until we have received the returned goods or until you have provided evidence that you have returned the goods, whichever occurs first.

without undue delay and, in any event, no later than 14 days from the day on which you informed us of your withdrawal from this contract.

The deadline is met if you dispatch the goods before the 14-day period has expired.

You shall bear the direct costs of returning the goods.

You are only liable for any diminished value of the goods resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.

Section 6 – Exclusion of the Right of Withdrawal

The right of withdrawal does not apply:

if you are not a consumer within the meaning of Section 13 of the German Civil Code (BGB);
to goods that are not prefabricated and for the manufacture of which an individual selection or specification by the customer is decisive, or which are clearly tailored to the customer's personal needs;
to sealed audio or video recordings or computer software if the seal has been removed after delivery.

Section 7 – Delivery

Unless otherwise agreed, delivery shall be made to the delivery address specified by the customer.

Any information regarding delivery times is non-binding unless a delivery date has been expressly confirmed as binding.

In individual cases, sizezero GmbH may offer to deliver a product that is temporarily unavailable at a later date once it becomes available.

No additional shipping charges or cash-on-delivery fees will be charged for such subsequent deliveries.

Section 8 – Exchanges

sizezero GmbH is under no obligation to exchange goods that are free from defects.

Where possible, we will generally accommodate requests for exchanges at our discretion.

We reserve the right to charge additional shipping costs for the dispatch of replacement goods.

Your statutory right of withdrawal under Section 4 remains unaffected by this provision.

Section 9 – Payment

We currently offer the following payment methods:

Debit and credit card payments via PayPal
Bank transfer (prepayment)
Cash on delivery
Payment upon collection

The available payment methods displayed during the checkout process shall apply to your order.

Section 10 – Due Date and Default

Unless otherwise agreed, the purchase price shall become due immediately upon conclusion of the contract.

If a different payment deadline has been granted by us, that deadline shall apply.

Section 11 – Reminder Fees

We do not charge reminder fees.

If payment has not been received within seven (7) days of the invoice date, we reserve the right to cancel the order.

Section 12 – Set-Off and Right of Retention

You may only exercise a right of set-off if your counterclaims have been legally established, are undisputed, or have been expressly acknowledged by sizezero GmbH.

You may exercise a right of retention only to the extent that your claim arises from the same contractual relationship.

Section 13 – Retention of Title

The goods shall remain the property of sizezero GmbH until full payment of the purchase price has been received.

Section 14 – Warranty and Liability

The statutory warranty provisions shall apply.

The warranty period is two (2) years from the date the goods are delivered.

Warranty claims shall initially be limited to subsequent performance, either by repair of the defective goods or by replacement delivery, as provided by applicable law.

Unless otherwise provided below, any further claims, regardless of their legal basis, shall be excluded.

Accordingly, sizezero GmbH shall not be liable for damages that do not directly affect the delivered goods, including, but not limited to, loss of profit or other indirect financial losses.

To the extent permitted by law, any limitation or exclusion of liability shall also apply to the personal liability of our employees, legal representatives, and agents.

The above limitations of liability shall not apply in cases of:

intentional misconduct or gross negligence;
injury to life, body, or health;
claims arising under the German Product Liability Act (Produkthaftungsgesetz);
breach of an essential contractual obligation where liability cannot be excluded under applicable law.

Section 15 – Privacy and Data Security

The personal data you provide during the ordering process, including your name and address, is transmitted using encrypted technology to protect it against unauthorized access.

sizezero GmbH uses Secure Socket Layer (SSL) encryption to ensure secure data transmission.

By placing an order, you consent to the storage, processing, and use of your personal data for the purpose of fulfilling your order and maintaining the customer relationship, in accordance with applicable data protection laws.

Section 16 – Governing Law

These Terms and Conditions and all legal relationships between you and sizezero GmbH shall be governed exclusively by the laws of the Federal Republic of Germany.

The United Nations Convention on Contracts for the International Sale of Goods (CISG) shall not apply.
